“Termite Tom” Campbell and Brandon Falls, former District Attorney for Alabama’s largest county (Jefferson), led the charge against Terminix, proving that the company failed to properly treat or retreat the coastal Alabama home, even after termite damage was discovered. Though TMX made hundreds of thousands of dollars in repairs over years, the Campbell Law PC team discovered the pest control company failed to find all of the damage they had caused by decades of incomplete and worn-off treatments, so any repairs were always incomplete repairs. While the repair process drug on for years, Terminix still never fully treated the property, and the home stayed infested with termites.
Campbell and Falls painted a picture in arbitration of Terminix’s cycle of improper/incomplete termite prevention treatments, incomplete discovery of the extent of the damage caused by the termite infestations, and incomplete repairs. Terminix’s national manager of termite damage claims, Jeff Curtis, failed to see to it that the customer’s property treatments were complete, and Curtis never authorized finding the end of the termite infestation.
Finding the full extent of the damage is critical. Even small evidence of termite activity usually means massive scale property damage. Also, termites will tunnel through pinholes inside wood and between or inside building materials, so the damage they leave isn’t always linear and will skip around. Terminix’s own witnesses had to admit at trial that finding the full extent of damage needs to be done but that Terminix does not do it. The Arbitrator agreed that all the spray foam insulation in the home needs to come out in order to determine the end of the infestation and damage.
Campbell Law PC’s client, a physician, bought the beach house in Baldwin County with the hope that he and his wife would host their grandchildren during the summers to enjoy quality time with the kids and see them mature and grow. Instead, the home sat vacant for years as termite damage repairs drug on. Missing those special experiences was the crux of the couple’s mental anguish claim against Terminix.Though repair costs in this case were high, Campbell Law PC was also able to recover damages against Terminix for mental anguish. Because Campbell and Falls were able to prove Terminix committed fraud, the Arbitrator hit Terminix with $1 Million in punitive damages, bringing the total award to over $2,600,000.
Campbell hopes this case will be a cautionary tale for other homeowners. Terminix customers need to understand that failing to provide proper treatments and retreatments and failing to find and repair all the termite damaged caused isn’t incidental in this case. This cycle is part and parcel of the Terminix playbook—a universal practice. Numerous other clients have allowed Terminix to make repairs instead of getting an experienced and knowledgeable lawyer to handle their termite damage claims, and it turned out that the repairs were incomplete – necessitating that clients move in and out of their homes multiple times or live in construction misery for substantially longer than it would take if the work was done right the first time.
Campbell warns that affluence won’t protect homeowners from mistreatment by Terminix.

Maybe it is because they believe they are unlikely to get cheated again because of their ability to ‘lawyer-up’ if necessary.
